Handling of Personal Information

Mitsubishi Electric India Pvt. Ltd. a company established and registered under the laws of India (hereinafter be referred as "Mitsubishi Electric" or “we” or “our” or “Company”) sometimes collects personal data from its Business Partner’s including but not limited to Channel Partners, Authorized service providers, Distributors, suppliers, vendors, consultants etc. or Industrial/other Customers directly during appointment / registration for meeting its business obligation and other related services and personal information from Customer’s through our website or Company Toll free Number or Customer Support or whatsapp chatbot services for providing enquiry & delivery information about Company’s products & other services, product service complaints including warranty administration Installation services and any other services relating to the product including promotional / marketing notification for company products. This policy shall regulate the collection, storage, use, disclosure, retention and transfer and deletion of personal information which shall be collected physically or electronically and then digitalized. [Business Partner(s) and Customer collectively hereinafter referred to as “You”).

Mitsubishi Electric processes personal data in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act") and applicable Rules notified thereunder. For the purposes of the DPDP Act, Mitsubishi Electric India Pvt. Ltd. acts as a “Data Fiduciary” in relation to the personal data processed by it.

This policy explains how Mitsubishi Electric treats the information about you that we receive on the Internet or physically and then subsequently digitalised. Personal data is collected only for lawful purposes and based on valid consent or other lawful uses permitted under the DPDP Act.
2. When we directly collect personal data from you in physically or electronically and then digitalized , we will specify how we intend to use the information provide contact information and ask for your consent.
   At the time of collection, we provide a clear and itemised Notice, presented in clear and plain language and made available independently of any other information, specifying:

2. We collect only such personal data as is necessary for the lawful purpose.
3. We may at times acquire commercially-available lists or directories.
4. Mitsubishi Electric will not collect, use, or provide to any third party any personal information such as the following without your consent.

Mitsubishi Electric uses the personal data we receive from our Business Partner’s including but not limited to Channel Partners, Authorized service providers, Distributors, suppliers, vendors, consultants etc. or Industrial Customers to execute registration, contracts, and commercial & payment transactions concluded between you and Mitsubishi Electric.
2. Mitsubishi Electric uses personal information of Customer to provide with relevant information that may be of interest such as information on our products, solutions, and associated services relating to products.
3. Mitsubishi Electric uses personal information of business Partners including but not limited to Channel Partners, Authorized service providers, Distributors, suppliers, vendors, consultants etc. or Industrial / other Customers as obtained during their appointment / registration strictly for meeting with the following lawful purposes:
   • Business communications and correspondence;
   • Conducting business discussions, meetings, surveys, Marketing & promotional activities, procurement, commercial & payment transactions, reconciliation of accounts, social media ad posts, Exhibition participation within India or overseas;
   • Parent / Group / Affiliates companies within India or overseas, if required
   • Executing/processing of Annual Maintenance contracts for product services, quotations, product enquiry, warranty administration, after sales services, Extended warranty, Preventive Maintenance services / Warranty services, complaint handling, Customer communication;
   • Administration of incentive schemes, reward programmes, Mitsubishi Electric Incentive Factory Japan tour and foreign travel schemes;
   • Business Partner registration and management, Audit purposes, office / residential properties on lease for office/employees
   • Compliance with applicable legal, regulatory, tax and statutory requirements;
   • Protection and enforcement of the Company's legal rights and obligations; and
   • Any other purpose directly connected with the business relationship between you and the Company.
4. Mitsubishi Electric uses the personal data we receive from Customer(s) on our website or Company Toll free Number or Customer Support or whatsapp chatbot services are generally name, company name (if any), residential / office address, state, city, contact no, email address (if any). The same is used for locating the related Business Partner who can satisfy your requirement in your city and your contact details are used to contact Customer to (a) respond to your product-related inquiries; (b) providing product-related services including after-sales support, warranty administration, and technical assistance or any other services relating to the product or promotional mails/notification for our products/services including extended warranty or Annual maintenance
5. Mitsubishi Electric will not use personal information we receive from you for purposes other than those specified at the time of collection and defined above unless such processing is permitted under DPDP Act or fresh consent is obtained. However, we may use the information to—without personally identifying individuals—gather statistical data on the number of visitors our website receives, sales volume, and information on how visitors navigate through our website.
6. We retain personal data only for as long as necessary for the purpose for which it was collected or as required under applicable law or until no specific request for withdrawal or erasure from your side. Upon completion of the purpose, personal data shall be erased unless retention is required by law.

When We Disclose or Provide your Personal Information to Third Parties

As a rule, Mitsubishi Electric does not disclose or provide the personal information we receive from you to any third party, except in the following cases:

1. When we have your consent.

When we employ / engage a third party for extending other business-related services on our behalf under a valid contract for various assignment / services undertaken which includes inter-alia, to perform services that are necessary to achieve business objectives, and with no other illicit / unlawful purposes.
3. When personal information is provided in conjunction with the succession of business resulting from a merger or other transfers of business.
4. When it is necessary to comply with any law in force in India, or with any judgment, decree or order issued under any law in force in India.
5. When it is necessary to respond to a medical emergency involving a threat to life or an immediate threat to the health of any person.
6. When it is necessary to take measures to provide medical treatment or health services to any individual during an epidemic, outbreak of disease, or other threat to public health.
7. When it is necessary to take measures to ensure safety or provide assistance during any disaster or breakdown of public order.
8. To stop the provision of personal information to third parties without customer consent:

   It may at times be necessary for Mitsubishi Electric to provide personal data received from Business Partners including but not limited to Channel Partners, Authorized service providers, Distributors, retailers, suppliers, vendors, consultants etc. or Industrial Customers and Customers to Mitsubishi Electric affiliates / group Companies located both in India and abroad for a lawful business purpose. Any transfer of personal data outside India will comply with Section 16 of the DPDP Act and will not be made to any country or territory that the Central Government may restrict by notification. Such transfer is subject to your consent given to Mitsubishi Electric and to the requirements, restrictions or conditions applicable under the DPDP Act and the rules made thereunder.

Stopping provision of personal information to third parties

In case Business Partners including but not limited to Channel Partners, Authorized service providers, Distributors, suppliers, vendors, consultants etc. or Industrial /other Customers may request that their personal information no longer be provided to third parties. You can write to our Grievance Officer, however some services we offer (including responses to your inquiries, process of service complaints) may not be available to you.

How We Protect your Personal Information

Mitsubishi Electric employs administrative, technical, personal, and physical safeguards to protect your personal information.

1. Mitsubishi Electric employs necessary safety measures, safeguards and takes necessary corrective actions to protect your personal information from unauthorized access, loss, destruction, alteration, or leakage.
2. Mitsubishi Electric employees receive regular education on safeguarding personal information.
3. In cases when Data Processor is hired by Mitsubishi Electric to provide services on our behalf, are commissioned to handle personal information, we select appropriate data processor and require them to sign all necessary agreements (Non-Disclosure agreement) concerning the handling of personal information. The agreements are signed prior to any services We initiate with them and will only use it in order to initiate and / or continue the services they are providing for us and also require them to employ all safety measures required by law to protect your personal information from unauthorized access, loss, destruction, alteration, or leakage, maintain confidentiality and provide reasonable assistance to Mitsubishi Electric in fulfilling applicable data protection obligations.
4. In the event of a personal data breach, upon becoming aware of it, Mitsubishi Electric shall intimate each affected Data Principal without delay, including a description of the breach, its likely consequences, mitigation measures taken by Mitsubishi Electric, and safety measures that the Data Principal may take. Mitsubishi Electric shall also notify the Data Protection Board of India without delay and provide detailed particulars of the breach, including its broad facts, mitigation measures and remedial measures, within 72 hours of becoming aware of the breach or such longer period as the Data Protection Board of India may allow.

Rights of Data Principal:

Under the DPDP Act, you have the following rights:

1. Right to access information about personal data which is being processed and the description of all processing activities with respect to such personal data.
2. Right to obtain the identities of all other Data Fiduciaries and Data Processors with whom personal data has been shared
3. Right to correction, completion, updating and erasure of personal data.
4. Right to withdraw consent.
5. Right to grievance redressal.
6. Right to nominate any another person to exercise rights in case of death, unsoundness of mind or infirmity of body. Your nominee can manage, access, or request changes to your Personal Data on your behalf, subject to proper verification.
7. Right to read and understand the privacy policy in English or any language specified in the Eighth Schedule to the Constitution. In the event of any inconsistency or conflict between the English version and a translated version, the English version shall prevail.

Duties of Data Principal

As a Data Principal, you shall:

1. Comply with all applicable laws for the time being in force while exercising rights under the DPDP Act.
2. Not impersonate another person while providing personal data.
3. Not suppress material information or submit false particulars while providing personal data.
4. Not register a false or frivolous grievance or complaint with the Company or the Data Protection Board of India.
5. Furnish only verifiably authentic information when exercising the right to correction or erasure.

Questions Concerning Personal Information

1. You may request the disclosure of any of your personal information in our possession. You may also enquire about the results of such requests and request revisions when necessary.
2. You may contact our Grievance Officer, Mr. Naveen Bhutani, who is the person able to answer, on behalf of Mitsubishi Electric India Pvt. Ltd., your questions about the processing of your personal data.
3. Mitsubishi Electric India Pvt. Ltd. will respond to grievances within the time period published by the Company and, in any event, within the period prescribed under the DPDP Rules, 2025. We have appointed the Grievance Officer expressly for this purpose. A Data Principal may approach the Data Protection Board of India only after exhausting the Company’s grievance redressal mechanism.

If you have any questions or any Grievance relating to your personal information or intend to withdraw consent or erase your personal data, you may contact our Grievance Officer for resolution however some services we offer (including responses to your inquiries, process of service complaints) may not be available to you once consent withdrawn or personal data erased.

Children

Mitsubishi Electric shall obtain verifiable consent of the parent or lawful guardian before processing a child’s personal data. Mitsubishi Electric shall adopt appropriate technical and organisational measures to verify that the person providing such consent is an identifiable adult, consistent with the DPDP Act and applicable Rules.

Mitsubishi Electric shall process personal data of children in compliance with the DPDP Act and shall not undertake tracking, behavioural monitoring, or targeted advertising directed at children.

Disputes
